An arbitration hearing is where witnesses are cross-examined, experts are tested and counsel present oral arguments. Preparation in the weeks beforehand has more influence on the outcome than anything said on the day.

Four to six weeks before: confirm the hearing schedule, the venue or virtual platform, and the order of witnesses. Finalise the hearing bundle. Make sure every document referred to in witness statements and expert reports is in the bundle and correctly paginated.

Two to four weeks before: prepare witnesses. Witnesses should re-read their own statements and the key documents, understand the hearing process, and know that their job is to answer questions truthfully and clearly. Witness preparation is about familiarity with the process, not rehearsing answers.

One week before: settle logistics. For in-person hearings, book the hearing room, breakout rooms for each party, transcription and technical support. For hybrid hearings, test the video platform, document display and connections for remote witnesses.

On the day: arrive early, check equipment, and keep a running list of documents and points raised by the tribunal. After each day, review the transcript and adjust plans for the next day.

A well-equipped venue removes much of the stress. At Nexus Justice Arbitration Centre, hearing rooms, breakout rooms and conferencing facilities can be booked online in advance.
